What is Divorce Mediation and How Does the Process Work?

Mediation allows couples to maintain more control over the outcome of their case. Rather than having a judge decide important issues such as property division, parenting time, and legal decision-making authority, the parties work together to craft their own agreements. This often leads to more customized solutions and a smoother transition moving forward.

The process and services for flat rate mediation are as follows:

  • Each party will gather the required information required under Rule 49 of the Arizona Rules of Family Law Procedure. This typically includes financial disclosures such as income information, assets, debts, and other relevant documentation necessary for informed negotiations.
  • Our firm will review the documentation provided to ensure that both parties have exchanged the information needed to engage in meaningful discussions.
  • The parties will choose a day and meet at our office, either in the same room or in separate rooms, and our firm will go back and forth between the parties and help the parties come to an agreement. This structure allows for flexibility and can help reduce tension in high-conflict matters.
  • During mediation, we will facilitate discussion on all relevant issues, including division of assets and debts, spousal maintenance, parenting plans, child support, and any other matters specific to the parties’ circumstances.
  • Once agreements have been reached, our firm will draft up the documentation evidencing the parties’ agreements for the Court’s signature. These can be consent decrees, parenting plans, or property settlement agreements.
  • Once each party has approved documentation and signed the documentation, the process is over.
